These general terms and conditions of sale (GTCS) apply between :
Lumihome, a French Société par Actions Simplifiée (simplified joint stock company), with a share capital of 700,000 euros, registered with the Registre du Commerce et des Sociétés d'Évry under number 880 752 266 R.C.S. Évry, hereinafter referred to as "the Company",
And
Any natural person making a purchase via the website www.lumihome-france.com and/or www.lumihome.com, hereinafter referred to as the "Buyer".
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions of distance selling between the Company and the Buyer, from ordering to payment and delivery. They govern all the steps involved in placing an order and ensure its follow-up.
Placing an order on the website published by the Company implies unreserved acceptance of the present conditions.
The Buyer declares that he/she is at least 18 years old and has the legal capacity or parental authorization to place an order on the site.
ARTICLE 1: CONFORMITY AND AVAILABILITY OF PRODUCTS
The products offered for sale by the Company are those listed on the site at the date of consultation by the Buyer.
They are offered for sale while stocks last. In the event of unavailability of a product after the order has been placed, the Company will inform the Buyer as soon as possible by e-mail. The Buyer may then choose a product of equivalent quality and price, or cancel the order.
The descriptions and photographs of the products presented on the site are provided for information only and have no contractual value.
ARTICLE 2: PRICES
The prices shown on the site are in euros, inclusive of all taxes, including VAT, but excluding shipping costs.
In the event of a change in the VAT rate, these changes may be reflected in the price of the articles without prior notice.
WEEE eco-contribution: LED bulbs
In accordance with environmental regulations, a contribution to the disposal of waste electrical equipment is included in the prices displayed.
ARTICLE 3: PAYMENT (SECURE PAYMENT)
Orders can be paid for by :
- Credit card
- PayPal service
- Cheque (payable to Société Lumihome)
- Bank transfer
Orders paid by cheque are processed on receipt of payment, which is cashed immediately.
For payments via PayPal, bank details are managed directly by PayPal and are not accessible to the Company.
In accordance with article L.441-6 of the French Commercial Code, any delay in payment will result in the application of compensation calculated at three times the legal interest rate in force, as well as a flat-rate compensation of 40 euros for collection costs.
ARTICLE 4: ORDERING
Any order implies express and irrevocable acceptance of the prices, product descriptions and these GTC.
After validation of the order, the Company sends a confirmation e-mail to the Purchaser.
ARTICLE 5: SHIPPING & DELIVERY
Orders are shipped to the address indicated by the Buyer.
Orders in stock are dispatched within 24 to 48 hours (excluding weekends and public holidays). Delivery is by CHRONOPOST® Relais, or GEODIS to your home.
Shipping costs
Charges include packaging, handling and postage. They vary according to delivery method and destination.
Any order not claimed within the time limit set at the relay point will be automatically returned to Lumihome. No refund will be made in this case. The customer may, however, request a credit note valid for one month or a reshipment of the parcel, the latter being subject to shipping costs at the customer's expense.
Clause: Customer exports - VAT
Sales made by Lumihome.com are deemed to be delivered in mainland France, and subject to value added tax (VAT) in accordance with current French tax legislation.
If, after delivery, the customer himself organizes the dispatch or transport of the goods to a territory not included in the scope of application of French VAT (such as the overseas departments of Martinique, Guadeloupe, French Guiana, Reunion and Mayotte), this subsequent operation does not entitle the customer to a refund or zero-rating of the invoiced VAT, except with our prior written agreement.
Any customer wishing to benefit from a VAT exemption must inform Lumihome.com prior to the conclusion of the sale, and provide all the necessary supporting documents (customs documents, proof of exit from the tax territory, etc.). Otherwise, the sale will remain subject to French VAT.
ARTICLE 6: RIGHT OF WITHDRAWAL
In accordance with the law, the Buyer has 14 days from receipt of the products to exercise his right of withdrawal, without justification or penalty, except for the cost of return.
Products will only be reimbursed within 14 days, subject to receipt of the product in perfect condition.
ARTICLE 7: WARRANTY AND LIABILITY
The Company is liable for defects in conformity existing at the time of delivery. The warranty does not cover products that have been modified, repaired or misused.
Our solar-powered luminaires are guaranteed for between 2 and 5 years from the date of purchase, in accordance with the provisions of Articles L.217-1 et seq. of the French Consumer Code concerning the legal guarantee of conformity.
Luminaires are delivered with a lithium-ion battery (e.g. 18650 - 2200 mAh), supplied as a consumable. As a wearing part, the battery is not covered by the warranty in the event of failure due to normal wear and tear or inappropriate use (e.g. extreme temperatures, prolonged storage without recharging, etc.).
However, the battery remains covered by the legal warranty of conformity in the event of an initial defect, i.e. if a malfunction results from a defect present at the time of delivery of the good.
Apart from the legal warranty, no specific commercial warranty applies to the battery.
ARTICLE 8: PERSONAL DATA
The Company undertakes to protect the Buyer's personal data in accordance with the French Data Protection Act.
ARTICLE 9: APPLICABLE LAW
These terms and conditions are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action is taken.
