PREAMBLE
These general terms and conditions of sale (GTCS) apply between :
Lumihome, a French Société par Actions Simplifiée (simplified joint stock company), with a share capital of 700,000 euros, registered with the Registre du Commerce et des Sociétés d'Évry under number 880 752 266 R.C.S. Évry, hereinafter referred to as "the Company",
And
All individuals making a purchase via the website www.lumihome-france.com and/or www.lumihome.comhereinafter referred to as "the Buyer.
The purpose of these General Terms and Conditions of Sale is to define the terms and conditions of distance selling between the Company and the Buyer, from ordering to payment and delivery.
They govern all the stages necessary for placing an order and ensure its follow-up.
Placing an order on the website published by the Company implies unreserved acceptance of the present conditions.
The Buyer declares that he/she is at least 18 years old and has the legal capacity or parental authorization to place an order on the site.
ARTICLE 1: CONFORMITY AND AVAILABILITY OF PRODUCTS
The products offered for sale by the Company are those appearing on the site at the date of consultation by the Buyer.
They are offered for sale within the limits of available stocks. If a product is unavailable after an order has been placed, the Company will inform the Buyer as soon as possible by e-mail. The Buyer may then choose a product of equivalent quality and price, or cancel the order.
The descriptions and photographs of the products presented on the site are provided for information only and have no contractual value.
ARTICLE 2: PRICES
The prices shown on the site are in euros, inclusive of all taxes (including VAT) and exclusive of delivery charges.
In the event of a change in the VAT rate, these changes may be reflected in the price of the articles without prior notice.
WEEE eco-contribution: LED bulbs
In accordance with environmental regulations, a contribution to the disposal of waste electrical equipment is included in the prices displayed.
Promotional offers :
All new customers benefit from a welcome offer applicable to the total amount of their first order.
- Outside the legal sales periods, Lumihome reserves the right to offer, throughout the year, various promotional discounts or commercial advantages, without prior notice and according to the conditions defined on the site at the time of purchase.
Bundle offers (several products together in the same package, with a special benefit (discount, free product, etc.)) cannot be combined with the welcome offer or any other discount or promotion.
Promotional offers are valid while stocks last and for the period indicated on the site at the time of publication.
ARTICLE 3: PAYMENT (SECURE PAYMENT)
Orders can be paid for by :
- Credit card
- PayPal service
- Cheque (payable to Société Lumihome)
- Bank transfer
Orders paid by cheque are processed on receipt of payment, which is cashed immediately.
For payments via PayPal, bank details are managed directly by PayPal and are not accessible to the Company.
In accordance with article L.441-6 of the French Commercial Code, any delay in payment will result in the application of compensation calculated at three times the legal interest rate in force, as well as a fixed indemnity of 40 euros for collection costs.
ARTICLE 4: ORDERING
Any order implies express and irrevocable acceptance of the prices, product descriptions and these GCS.
After validation of the order, the Company sends a confirmation e-mail to the Buyer.
ARTICLE 5: SHIPPING & DELIVERY
Orders are dispatched to the address indicated by the Buyer.
Orders in stock are dispatched within 24 to 48 hours (excluding weekends and public holidays).
Home delivery is provided by CHRONOPOST® Relais or GEODIS.
Processing and delivery charges
Processing fees include packaging, handling and postage. They vary according to the delivery method selected and the destination.
Accelerated delivery LUMIPRIME
Domicile LUMIPRIME: 24h expedited delivery: €12.90 in mainland France only.
We have an express delivery contract within 1 working day with our partner carriers Geodis and Chronopost.
Orders placed before 12 noon (Monday to Thursday) with the LUMIPRIME option are prepared and handed over to our carriers on the same day, in accordance with this contract, to guarantee next-day delivery (excluding weekends and public holidays).
Orders placed before 12pm on Fridays with the LUMIPRIME option are prepared and handed over to our carriers the same day for delivery on Mondays.
Orders placed on Saturday and Sunday with the LUMIPRIME option are prepared on Monday and handed over that day for delivery on Tuesday.
Lumihome undertakes to respect preparation and dispatch deadlines until the package is handed over to the carrier. However, despite these commitments, Lumihome cannot be held responsible for any delay attributable to Geodis or Chronopost (tour incident, strike, weather conditions, overload, etc.).
In the event of a delay, the parcel remains a priority in the express circuit and will be delivered as soon as possible. No reimbursement of Lumiprime charges will be made if the order has been sent to the carrier within the agreed time.
Unclaimed orders
Any order not claimed within the time limit set at the relay point will be automatically returned to Lumihome by the carrier, who will notify the recipient by email or SMS.
The customer may then request Lumihome's customer service:
-
reshipment of the parcel, which will incur shipping costs at the customer's sole expense.
Clause: Customer exports - VAT
Sales made by Lumihome.com are deemed to be delivered in mainland France, and subject to French VAT in accordance with current legislation.
If, after delivery, a customer arranges for the goods to be dispatched to a territory not subject to French VAT (DOM, etc.), this operation does not entitle the customer to a refund or tax exemption, unless prior written agreement has been obtained.
Any customer wishing to benefit from a VAT exemption must inform Lumihome prior to the conclusion of the sale and provide the necessary supporting documents. Otherwise, the sale will remain subject to French VAT.
ARTICLE 6: RIGHT OF WITHDRAWAL
In accordance with the law, the Buyer has 14 days from receipt of the products to exercise his right of withdrawal, without justification or penalty, except for the cost of return.
A credit note or refund will be issued within 14 days, subject to receipt of the product in perfect condition.
ARTICLE 7: WARRANTY AND LIABILITY
7.1. Legal warranties
In accordance with the legal provisions in force, the products sold by Lumihome benefit :
-
the legal guarantee of conformity provided for in articles L217-3 to L217-14 of the French Consumer Code, enabling the Buyer to obtain, free of charge, the repair or replacement of the non-conforming product delivered. If these solutions are impossible, the Buyer may request a price reduction or cancellation of the sale;
-
the legal warranty against hidden defects provided for in articles 1641 to 1649 of the French Civil Code, applicable in the event of a defect rendering the product unfit for its intended use.
These warranties apply independently of any commercial warranty that may be offered by Lumihome.
For all warranty claims, the Purchaser must contact customer service at the following address: sav@lumihome.comspecifying the order number and attaching photos of the product concerned.
7.2. Warranty exclusions
Guarantees do not cover :
-
damage resulting from improper installation or use that does not comply with the product manual or specifications;
-
damage due to external causes (falls, shocks, excessive humidity, power surges, etc.);
-
interventions, repairs or modifications carried out by a third party not approved by Lumihome ;
-
normal wear and tear of the product or natural ageing of components ;
-
for Lumihome solar product ranges, batteries are considered consumables and are not covered by the warranty.
However, we will only consider taking responsibility for a luminaire purchased less than six (6) months ago.
After this period, no claims relating to the battery will be accepted.
7.3. Liability of the Company
Lumihome shall not be held responsible for :
-
indirect, immaterial or consequential damages, such as loss of profit, operating loss, loss of data or moral prejudice;
-
consequences of improper use or failure to comply with safety and maintenance instructions;
-
delays or impossibility of delivery due to force majeure, as defined by French case law (strike, natural disaster, war, transport breakdown, etc.).
Lumihome's liability, for any reason whatsoever, is strictly limited to the total amount of the order paid by the Buyer.
7.4. Technical limitations
Lumihome products comply with the standards in force at the time of sale. However, the Buyer is responsible for verifying the technical compatibility of the equipment ordered with his or her electrical or environmental installation.
ARTICLE 8: PERSONAL DATA
The Company undertakes to protect the Buyer's personal data, in accordance with the French Data Protection Act and the General Data Protection Regulation (RGPD).
For further information, the Buyer may consult the Privacy Policy available on the site.
ARTICLE 9: APPLICABLE LAW
These General Terms and Conditions are subject to French law.
In the event of a dispute, a amicable solution will be sought before any legal action is taken.

ARTICLE 10: MEDIATION OF DISPUTES
In the event of a dispute, the Buyer is invited to contact Lumihome's customer service department as a matter of priority in order to seek an amicable solution.
In accordance with article L612-1 of the French Consumer Code, the Buyer also has the possibility of having recourse, free of charge, to an approved consumer mediator for any dispute not resolved amicably.
Failing amicable agreement, disputes will be submitted to the competent courts in accordance with common law.
